| Title insurance is insurance that protects a person from losses that arise from a property ownership dispute; it is protection against loss arising from problems connected to the title to your property. Before you purchased your home, it may have gone through several ownership changes, and the land on which it stands went through many more. There may be a weak link at any point in that chain that could emerge to cause trouble. For example, someone along the way may have forged a signature in transferring title. Or there may be unpaid real estate taxes or other liens. Title insurance covers the insured party for any claims and legal fees that arise out of such problems.

Owner's title insurance:
Owner's title insurance, in the amount of the real estate purchase, is purchased for a one-time fee at closing and lasts as long as you or your heirs have an interest in the property. Owner's title insurance fully protects the buyer should a problem arise with the title that was not uncovered during the title search, and pays for any legal fees involved in defending a claim to your title.

By conducting a title search, an agent looks at past versions of the title and related contracts to make sure that all the owners have received the title properly (for example, after paying off all the necessary liens or mortgages). If there are any defects ("clouds"), these need to be rectified before any new transfer of the title is closed. A good title insurance policy will protect you against any reasonable losses, or if any defects are discovered despite your best efforts. Of course, the title policy won't cover clouds that crop up after you buy the property. |
